Appeal court dismisses Oyetola's Cross appeal in governorship suit
The All Progressives Congress APC and former governor Adegboyega Oyetola's cross-appeal against the decision of the Osun State Election Petition Tribunal has been rejected.
The cross-appeal, which focused on governor Ademola Nurudeen Adeleke's educational background, was dismissed for lack of merit.
The Appeal Court ruled that the matter has been resolved and cannot be revived in the same manner as Oyetola's actions due to the Court of Appeal verdict rendered in 2019 concluding that Adeleke did not fake the certificate presented for the 2018 governorship election.
The Court of Appeal verdict was upheld as legal and enforceable by any lower court or tribunal, according to Justice Lawal Shuaib's lead and unanimous ruling on Friday.
According to Justice Shuaib, the tribunal erred by making conclusions about a purported certificate forgery that had already been settled by the Court of Appeal.
After dismissing the cross-appeal, Judge Shuaib did not impose any costs on Oyetola or the APC.
