Naira Marley arraigned for credit card fraud
The trial of Azeez Fashola, commonly known as Naira Marley, resumed Friday in federal court in Ikoyi, Lagos.
The Economic and Financial Crimes Commission (EFCC) presented further evidence against the music star.
Naira Marley is on trial on 11 counts bordering on credit card fraud.
Judge Nicholas Oweibo dismissed his objection to the forensic evidence previously presented.
At the resumption of the hearing, prosecuting witness Dein Whyte, an EFCC staff member, continued his presentation.
At the June 9, 2022, hearing, defence attorney Olalekan Ojo disagreed with the witness's opinion on the forensic evidence linking the artist.
The Senior Advocate of Nigeria (SAN) argued that only the court could testify to the accused's guilt, not an investigator.
Judge Oweibo dismissed the objection, saying an investigator must be able to link the accused to the commission of the crime.
“It is the duty of law enforcement or the police to bring a person to justice to investigate whether or not the accused committed the crime.
"The prosecutor must have decided on the defendant's involvement before taking the case to court," the judge said.
