Tribunal dismisses second petition against Tinubu

The Action Peoples Party (APP) has dropped their suit opposing Senator Bola Ahmed Tinubu of the All Progressives Congress (APC) becoming the winner of the presidential election on February 25, 2023.

The party notified the court about the motion on notice dated and filed on May 9 stating the party's desire to withdraw the action number CA/PEPC/02/2023 in accordance with paragraph 29, sub-sections 1, 2, and 4 of the election petition. The party did this through its attorney, Obed Agu.

He requested a court order allowing the petition to be withdrawn.

The case's respondents made no objections about the withdrawal.

”We commend the petitioner for the motion to strike out the petition and hope that more will still come,” the Respondents said.

Both the Independent National Electoral Commission (INEC) and the APC's legal representatives, Lateef Fagbemi and Abubakar Mahmoud, did not oppose the withdrawal.

In a short ruling, the Tribunal held that “Having considered the application, we are satisfied that there was no collision on the part of the Respondents.

“The petition is hereby dismissed, having been withdrawn,” the court held.
